Social Security disability claims
If you are unable to work due to a physical or mental condition (or a combination of both) you may be eligible for Social Security Disability (SSD) or Supplemental Security Income (SSI) benefits. But obtaining disability benefits from the government can be a complicated and frustrating process. There are multiple deadlines for filing documents, lots of complicated paperwork that must be completed, and very complex guidelines for determining whether or not an individual is eligible for Social Security Disability benefits.
At Ryan Bisher Ryan and Simons, we have the experience to help disabled Oklahomans through all the red tape associated with pursuing a Social Security Disability claim. We know how to develop and present a case to the Social Security Administration and we travel to hundreds of hearings throughout the State of Oklahoma each year to assure our clients obtain the benefits to which they are entitled.
Who can recover compensation for an injury in Oklahoma?
Under personal injury law, an injured party is entitled to compensation when the injury event meets the following criteria:
- A person or entity had a duty to be careful but was negligent or reckless.
- The negligent act or failure to act caused an accident.
- A person sustained injuries as a direct result of the accident.
At Ryan Bisher Ryan & Simons, our attorneys help injured Oklahomans recover for multiple types of injuries, including auto accidents, truck accidents, burn injuries, nursing home negligence, defective products, and medical malpractice. Recovery may be sought in a civil lawsuit against the responsible parties. When someone is hurt or killed because someone else acted without consideration for their safety and welfare, it is our job to make sure their rights are protected.
At Ryan Bisher Ryan & Simons in Oklahoma City, we use our knowledge, experience and resources to enforce accountability for your injuries. We vigorously pursue the maximum allowable compensation under the law.
What is workers’ compensation?
Oklahoma’s workers’ compensation laws provide for the payment of benefits to workers who sustain job-related injuries even if the worker was at fault. Benefits can include payments for medical care, weekly income, permanent disability income and rehabilitation. Almost every type of employment is covered. These laws apply to multiple types of injuries including broken bones, sprains and muscle strains. The law also provides coverage for repeated trauma type injuries (such as carpal tunnel), hernias, disfiguring scars, and hearing loss.
Pursuant to recent changes in the law, there are now two separate sets of rules and regulations that could potentially apply to an on-the-job injury. These rules and regulations are administered by two separate entities, the Oklahoma Workers’ Compensation Court and the Oklahoma Workers’ Compensation Commission. Each set of laws provides for different levels of benefits and each law has radically different time frames for filing a claim.
If you are a worker and you have sustained an injury on the job, our Oklahoma lawyers can determine which law applies to you, can assist you with filing your claim with the proper entity, and can make sure you receive each and every benefit to which you are entitled under Oklahoma law.
